Total Escape Agreement

This document is basically
for the safety of your personal well-being and security of the
company, Total Escape. I fully understand that there are risks and dangers inherent in participating in outdoor recreational sports/activities, hereinafter "Activities". I also understand that in order to be allowed to participate in Activities, I must give up my rights to hold Total Escape, it's employees liable for any injury or damage which I may suffer while participating in Activities. I understand and agree that this Waiver/Release/Agreement applies to all Activities whether they have occurred in the past, present, or future. I hereby voluntarily release Total Escape from any and all liability resulting from or arising out of my participation in Activities. I understand and agree that I am releasing not only the entities set forth above but also the members, officers, agents, and employees of those entities. In no way is Total Escape
to be held responsible for injuries or damage (personal or property)
that occur during these planned outings & Activities. Accidents
do occur in the wilderness and we will do our best to prevent
such problems, but you must be aware of the uncertainty in any
recreational outdoor situation. Take the advice of the experienced
guide in unfamiliar surroundings. Wilderness terrain can be ever-changing
and complex, so complete awareness is always advised. A map &
general understanding of the landscape is always recommended
if you are to venture away from the group. I have read Camp
Rules & Ettiquette section. I understand and agree that this Waiver/Release/Agreement will have the effect of releasing, discharging, waiving and forever relinquishing any and all actions or causes of action that I may have had, whether past, present or future, whether known or unknown, and whether anticipated or unanticipated by me, arising out of my participation in Trips and Activities.This Waiver/Release applies to personal injury, property damage, or wrongful death which I may suffer, even if caused by the acts or omissions of others. I understand and agree that by signing up for an activity or trip, I am assuming full responsibility for any and all risk of death or personal injury or property damage suffered by me while participating and/or receiving instruction in Activities. I understand and agree that this Waiver/Release will be binding on me, my spouse, my heirs, my personal representative, my assignees, my children and any guardian ad litem for said children. I understand and agree that by participating Trips and Activities hosted through Total Escape, I am agreeing to release, indemnify and hold Total Escape, harmless from any and all liability of costs, including attorneys fees, associated with or arising from my participation and/or receipt of instruction in Activities. I accept all legal responsibility resulting from my personal actions, omissions, or neglect while participating in Activities. I understand that I remain personally liable under local statute for any violation or penalty, civil or criminal, that results from my own action, omission, or neglect while participating in an Activity. Furthermore I agree to be financially responsible for all legal fees, penalties, and judgements resulting from legal action initiated by a third party against Total Escape , in which my action, omission, or neglect has a material impact on the proceedings. I acknowledge that I am at
least 21 years of age. I have read this Waiver/Release Agreement
and I understand the words and the language in it. I fully understand
the potential dangers incidental to participation and/or receiving
instruction in Activities. |
